Understanding the Duties of a Probate Attorney
Although you may have heard of a probate attorney, you may not exactly know what this type of lawyer actually does in his or her practice. In point of fact, a probate attorney is involved in quite a few different arenas.

In most states, the primary area in which a probate attorney practices involves wills and estates. When a loved one dies and has left a will, or does not have a will and yet has an estate that needs to be dealt with, a probate attorney is retained. These lawyers have specialized training and experience to deal with all of the technical aspects of assisting with a person’s property after death. The ultimate task of an attorney in this area is to make sure that the deceased intention’s regarding the disposition of his or her property is followed.
A probate attorney also deals with matters pertaining to trusts. Trusts are becoming more widely used in this day and age. Trusts are invaluable tools in estate planning. Therefore, there are now some lawyers that specialize exclusively in setting up and dealing with trusts.
In some states, a probate attorney also deals with adoption cases. (This does vary from state to state depending on what court in a given jurisdiction actually has oversight over adoption matters and cases.) In this cases in which a probate lawyer deals with adoption matters, that lawyer will be charged with assisting prospective parents in all matters relating to the establishment of parental rights through adoption proceedings.

In most jurisdictions a probate attorney also deals with guardianships and conservatorships. These are cases involving a person who is not able to take care of and manage his or her own affairs. A person who cannot manage his or her financial affairs needs a conservatorship. A person who is incapable of handling his or her financial affairs and is also incapable of taking care of his or her day to day affairs will be placed in a guardianship and conservatorship.
The duties of a probate attorney are many and varied. If you ever need the assistance of a probate attorney, you will want to make certain that you hire one who has experience necessary to satisfy your particular needs. Because the issues involved in probate law are so serious, it is important to make certain that you have the assistance of someone who truly knows what he or she is doing in regard to your case.
