Understanding the Duties of a Probate Attorney

Although you may have heard of a probate attorney, you may not exactly know what this type of lawyer actually does in his or her practice. In point of fact, a probate attorney is involved in quite a few different arenas.

In most states, the primary area in which a probate attorney practices involves wills and estates. (This does vary from state to state depending on what court in a given jurisdiction actually has oversight over adoption matters and cases.) In this cases in which a probate lawyer deals with adoption matters, that lawyer will be charged with assisting prospective parents in all matters relating to the establishment of parental rights through adoption proceedings.

In most jurisdictions a probate attorney also deals with guardianships and conservatorships. These are cases involving a person who is not able to take care of and manage his or her own affairs. A person who cannot manage his or her financial affairs needs a conservatorship. A person who is incapable of handling his or her financial affairs and is also incapable of taking care of his or her day to day affairs will be placed in a guardianship and conservatorship.
